Terms and Conditions for BusBuddy

Introduction

Welcome to BusBuddy! These Terms and Conditions ("Terms") govern your use of the BusBuddy mobile application and any related services provided by BusBuddy ("we," "us," or "our"). By accessing or using our application, you agree to comply with and be bound by these Terms. If you do not agree with these Terms, please refrain from using our application.

1. Use of the Application

1.1 Eligibility

You must be at least 12 years old to use the BusBuddy application. If you are under the age of 12, you may only use the application with the consent of a parent or guardian.

1.2 Account Registration

To access certain features of the application, you may be required to register an account. You agree to provide accurate, current and complete information during the registration process and to update such information as necessary to maintain its accuracy.

1.3 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security. We will not be liable for any loss or damage arising from your failure to comply with this obligation.

2. User Conduct

2.1 Prohibited Activities

You agree not to use the application for any unlawful purpose or in any way that could harm BusBuddy, its users, or any third party. Prohibited activities include, but are not limited to:

Using the application to harass, abuse or harm another person.
Impersonating any person or entity or falsely stating or otherwise misrepresenting your affiliation with a person or entity.
Interfering with or disrupting the operation of the application.
Attempting to gain unauthorized access to the application or its related systems or networks.
Engaging in any activity that could disable, overburden, or impair the proper functioning of the application.

3. Intellectual Property

3.1 Ownership

All intellectual property rights in the application and its content are owned by BusBuddy or its licensors. You are granted a limited, non-exclusive, non-transferable, revocable license to use the application for personal, non-commercial purposes only.

3.2 Restrictions

You may not copy, modify, distribute, sell, lease or create derivative works based on any part of the application or its content without our prior written consent. Any unauthorized use of the application may result in termination of your access and legal action.

4. Privacy

4.1 Privacy Policy

Your use of the application is also governed by our Privacy Policy, which explains how we collect, use and protect your personal data. By using the application, you consent to the collection and use of your data as described in our Privacy Policy.

5. Disclaimers and Limitation of Liability

5.1 No Warranty

The application is provided on an "as-is" and "as-available" basis without any warranties of any kind, either express or implied. BusBuddy does not warrant that the application will be uninterrupted, error-free, secure, or free from viruses or other harmful components.

5.2 Limitation of Liability

To the maximum extent permitted by law, BusBuddy shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from:

Your use or inability to use the application.
Any unauthorized access to or use of our servers and/or any personal information stored therein.
Any interruption or cessation of transmission to or from the application.
Any bugs, viruses, trojan horses, or similar components that may be transmitted to or through our application by any third party.

In no event shall our total liability exceed the amount paid by you for accessing the application (if applicable).

6. Indemnification

You agree to indemnify, defend and hold harmless BusBuddy, its affiliates and their respective officers, directors, employees and agents from and against any claims, damages, obligations, losses, liabilities, costs (including but not limited to attorney's fees), arising from:

Your use of and access to the application.
Your violation of any term of these Terms.
Your violation of any third-party right including without limitation any copyright, property right, or privacy right.

7. Termination

BusBuddy reserves the right to terminate or suspend your access to the application immediately and without prior notice for any reason whatsoever including but not limited to if you breach these Terms. Upon termination, your right to use the application will cease immediately.

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India without regard to its conflict of law provisions. Any dispute arising under these Terms shall be resolved exclusively in the courts located in Silchar, Assam, India.

9. Changes to Terms

We reserve the right at our sole discretion to modify or replace these Terms at any time without prior notice. If a revision is material (as determined at our sole discretion), we will provide at least 15 days' notice prior to any new terms taking effect. Your continued use of the service after such changes constitutes acceptance of those changes.
